TEXAS COMMISSION ON ENVIRONMENTAL QUALITY
SUBJECT: Application for a Department of the Army Permit under Section 404 of the Clean Water Act (CWA) and for water quality certification under Section 401 of the CWA to discharge dredged and fill material into waters of the United States associated with the proposed construction of the Nebraska Furniture Warehouse, located in The Colony, Denton County Texas.

LOCATION: The project site is located southwest of the intersection of SH 121 and W. Spring Creek Parkway in the city of The Colony, Denton County, Texas. The commercial development would be located along SH 121, which forms the northwest boundary. Spring Creek Parkway forms the boundary to the east, and Plano Parkway to the southwest (Sheet 1-2 of 9). The U.S. Geological Survey (USGS) North American Datum of 1983 coordinates for the proposed project are as follows: Latitude 33.08105˚ North, Longitude -96.85172˚ West. The site is mapped on the Hebron, Texas 7.5-minute USGS quadrangle map (Sheet 3 of 9) in the USGS Hydrologic Unit 12030103.

PROJECT DESCRIPTION: The applicant proposed to discharge approximately 970 cubic yards of dredged and fill material into approximately 1.2 acres of waters of the United States in conjunction with the construction of a commercial development. Total adverse impacts proposed impacts to waters of the U.S. are the direct, permanent fill of the 1.2 acre pond which lacks a wetland fringe.
