PUBLIC NOTICE UNDER SECTION 106 OF THE NATIONAL HISTORIC PRESERVATION ACT

FOR A PROGRAMMATIC AGREEMENT

AMONG

THE U.S. ARMY CORPS OF ENGINEERS, FORT WORTH DISTRICT,

THE CITY OF TEXARKANA, TEXAS,

THE TEXAS STATE HISTORIC PRESERVATION OFFICER, AND

THE CADDO NATION OF OKLAHOMA

REGARDING

THE WRIGHT PATMAN ULTIMATE RULE CURVE PROJECT

                                                                                                               

TITLE:  Programmatic Agreement Regarding the Wright Patman Ultimate Rule Curve Project

REQUESTER AND NON-FEDERAL SPONSOR:  City of Texarkana  

LOCATION:  The project is located at Wright Patman Lake in Bowie and Cass Counties, Texas.

BACKGROUND: The Wright Patman Ultimate Rule Curve project is defined by Contract DACW29-68-A-0103 among the United States of America and the City of Texarkana, Texas for Municipal and Industrial Water Supply Storage Space in Texarkana Reservoir. The Contract was approved by the Secretary of the Army on 11 July 1968 and was executed on 16 April 1968 (hereinafter the “Contract”), for the permanent reallocation of flood control storage to municipal and industrial water supply use under the Water Supply Act of 1958, as amended (43 U.S.C. 390b). As a U.S. Army Corps of Engineers (USACE) project occurring on federal lands, the Wright Patman Ultimate Rule Curve project is subject to Section 106 of the National Historic Preservation Act. The USACE seeks to develop a programmatic agreement to address NHPA compliance for the duration of the undertaking.

SOLICITATION OF COMMENTS:  The USACE is soliciting comments from all parties having an interest in the undertaking’s potential effect(s) on historic properties. Comments identifying historic cultural resource concerns within the area of potential effect (APE) or comments supporting, opposing, or identifying concerns with the documentation provided will be considered by the USACE.

CLOSE OF COMMENT PERIOD:  Written comments on documentation available at https://www.swf.usace.army.mil/Portals/47/docs/civilworks/WrightPatman/URC/WPPADraft4_PNv.pdf?ver=3TZ8lnn6hjZ9JfYPQP1xMg%3d%3d are requested beginning May 23, 2023 and should be submitted before or on the close of the comment period June 23, 2023.
